Booking Form

Firstly, please let me thank you for choosing to book me to capture your wedding. It’s going to be a great day and I’m looking forward capturing all the amazing moments for you.

To finalise the booking and secure your date with me there are three simple steps:

  • fill in the booking form below
  • read Terms and Conditions at the bottom of the page
  • arrange for the booking deposit. Normally this is 1/3 of your total Collection fee unless agreed otherwise. Payment can be made via internet banking to Yana Photography’s RBS account 10123244 sort code 83-04-25. By paying the deposit you’re agreeing to the terms of conditions.


Terms of business between Yana Photography and the Client 


It is mutually agreed that the following terms of business form an integral part of this contract. It is also agreed that the Parties agree to all its terms. Any modifications of these Terms must be in writing and signed by all parties.

Booking fee:Bookings are made strictly on a first come first served basis. The booking fee of one third of the complete collection booked together with the signed Terms of business secures the time and services of the Photographer for the wedding. This fee constitutes a non-refundable retainer. Weddings that are postponed to a later date will retain the fee as long as the Photographer can re-schedule for the new date and time. If Photographer is able to book only a lower-value package on the original date, Photographer will refund only the difference. Dates will only be reserved upon receipt of a full retainer and this contract signed and posted to the Photographer within 10 days from the date upon which it has been received by the Client. No work will be carried out unless the retainer is paid and this contract is signed and retuned to the Photographer.

Payments:
The second instalment (one third of the total fee) is due to be paid no later then 3 months before the wedding date. The remainder of the total payment must be paidon delivery of the preview images and no later then 14 days after the wedding.Please note the images will not be released without the final payment.All albums, re-prints and enlargements must be paid for in full at the time of ordering. 

Returned cheques:Returned cheques are subject to a £25.00 returned cheque fee. Client assumes responsibility for any and all collection costs and fees incurred by Yana Photography in the event if enforcement of this contract becomes necessary. 

Albums/album design/pricing:All albums purchased as part of the collection must be ordered no later then three months after the wedding, unless a written permission from the Photographer specifies otherwise. If the deadline is not met, an album will be produced according to the current price list. Approved design of an album takes twelve weeks to be produced, shipped and delivered to the client. Prices for additional portrait prints, albums, frames and other products are agreed to and shown on the current Price Guide and are subject to change three months after the wedding.


Display:The Photographer can make reproductions for the Client or for the Photographer’s portfolio, samples or self-promotion or for professional competitions and reviews. No use of the image/s will be made by the Photographer for other commercial reason except with the written permission of the Client.

Images:All image sizes are nominal. The Photographer will provide a pleasing colour balance but the Client accepts and agrees the Photographer will not guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials in man made fibres and that it is sometimes impossible to record photographically the exact colour seen by the human eye.

Retouching:Basic re-touching (removal of blemishes, colour correction) and cropping is included in the price. Any further retouching, digital manipulation and art finishing is available as an optional extra and will be charged at cost.

Artistic License:The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographer will not be held responsible for the lack of coverage caused for the following reasons: The Bride, Groom or wedding party not being on time, members of the wedding party are unavailable when called, if the wedding is running late or if restrictions regarding photography at the desired location of the wedding are in force. Due to the vagaries of the weather and the lack of willingness of the subject/s it may not be possible to capture all the images requested by the Client. The Photographer with the co-operation of the client will do their best to produce coverage of the wedding in the time allocated to them. The photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

Limitation of liability:The Photographer takes the utmost care with respect to the exposure, editing and production of all our products and services offered. Every effort will be made to assure satisfaction. However, the Photographer is not responsible for subjective interpretations of photography. Weddings are dynamic and fast moving events. The Photographer does not guarantee to capture any particular image(s) or meet any particular aesthetic criteria as part of its performance under this contract.

In the event the Photographer cannot comply with the terms of this contract due to negligence, oversight, accident, error, omission, any other avoidable or unavoidable circumstance, whether caused by the Photographer or otherwise, the Photographer’s liability for this or any other circumstance shall be limited to the amount paid up to that time by the Client. 

The Photographer will not be held liable for any incident arising from the interference of any present party, at any photographic location, that may affect quality of images or results in damage to any party.

In addition, failure by the Client to make any payment as and when agreed shall release the Photographer from any further responsibility under this contract, without the responsibility to return any monies previously paid to it under this contract. 

Copyright:The 1988 Copyright Design and Patents Act section 77 & 80 assigns the copyright of the photographs taken, to the Photographer. It is contrary to the Act and an offence to copy, scan or modify or allow the photographs we have created to be re-printed, duplicated, digitally re-produced, copied, scanned or altered (digitally or otherwise) without our expressed written permission. Client also agrees not to copy the images covered by this contract for sale or for the purpose of circumventing the sale of images by the Photographer; nor will the client authorize any reproductions of the images either complete or in part for any purpose and usage. 


Force Majeure:The due performance of the work detailed above is subject to the Photographer's alteration or cancellation owing to any cause beyond his control. In the unlikely event of the photographer's cancellation the following will apply 
A/arrangements will be made for another photographer of comparable qualification to cover the event with agreed fees remaining unchanged.
B/If this is not possible or acceptable a full refund will be given of all monies paid to the date of cancellation. 

Digital files:The digital files remain the property of the Photographer and remain on file for 2 years.

Complaints:In the unlikely event of a complaint arising from the work the Photographer will do all that is reasonable to ensure the matter is resolved promptly and fairly. The Client shall notify the Photographer in writing within 21 days of receipt of the final form images if they have a complaint regarding an issue which would be obvious within that 21 day period or otherwise, as soon as possible after the issue giving rise to the complaint has become apparent setting out the nature of the complaint in sufficient details so as to make it clear to the Photographer the nature of the complaint. 

By signing this document you are entering into a legally binding contract and you are urged to read the terms and conditions carefully. Signing this document deems that you have read and understood the terms and conditions contained in it.


Jurisdiction:This agreement is governed by English Law.
